Airventure 19 Bushcat Raffle

This kind of debacle, coupled with the RAAus attack on OzRunways vs Avplan and the RAAus vs AOPA trademark bollocks a couple years ago only serves to drive the knife further into sport flying in Australia.

We already have CAsA doing their darndest, we dont need our administrators adding fuel to the fire...

It must have been obvious that weather could cause a problem with the show. It can be insured against, but the cost is the problem. If you don't insure, then you are gambling and should be aware that the consequences could bit you.

RAAus has done what any sensible company would do, ie, it has distanced itself from legal action.

That is just what I would expect, but it does not mean that I applaud RAAus.

Wow! This will upset a few! Thought this debacle had slipped by almost unnoticed!

Comments on that FB page are interesting. A lot of angry punters there. Clay Marks comment is on the mark, the raffle organisers have broken every raffle law in the book, and someone is going to get ripped a new cloaca over those legal failures.

So you can now go in a raffle to buy the aircraft that you might have been in the raffle for to win. Yeah, nah.................

I recall Bolly Props and the Rotax were product suppliers under some promotion deal / benifit arrangement with the build so they may / must have some equity or interest in this matter.

The organisers should at least refund the portion of the ticket that would have contributed to the raffle. Whats that saying they drum in to us all “Failure to plan is planning to fail”. There possibly should have been more contingencies in the event organisation.

OK well if they are not awarding the plane as it isn't paid for...; The Rotax and the prop were donated!!! They should still be awarded....

I think the fairest way of sorting this would be to re raffle the aircraft.

People with Airventure tickets would receive their ticket free.

Others could pay to be in.

2000 tickets at $30 each roughly.....

Great idea but the fact is, this was a licensed raffle and has to comply with state rules and regulations put in by the lotteries commission or somebody else.

They are in breach of the regulations by not giving away the prize as specified on the day that the raffle closed.

If we had a stronger state government then they would be pursuing the people behind the event for compliance to everything they signed up for when registering the raffle/giveaway.

Me, I would not be buying anything because there could be some chance that it is not even legal to sell while of goods exist. If you purchase the goods (aeroplane) it may be a remote possibility that sometime in the future some sheriff comes knocking at your door saying you have purchased something illegally.

Do you want to run that risk by purchasing an aircraft that should be part of the raffle/competition before all legal recourse has been exhausted by those who entered the competition ?

Subject to their advertising saying that when you buy a ticket you are in the draw for that specific prize, that sounds about right.

 

This only affect those who bought tickets in that raffle. The rightful winner was one of those people. You can't deny them, as winners, then start a new raffle and widen the participants to make more money. If the raffle loses money, which they often do, the raffle loses money.

 

Probably the only reason this hasn't blown up is that everyone who bought a ticket is relying on everyone else to lodge a complaint. It's not up to the State Government to watch every raffle it's up to the entrants.

There is only one way this can be legally concluded. Those who bought tickets in the original raffle, ie entry tickets must have their tickets put in the raffle, it must be drawn and the winner given the plane. All states have rules for raffles and it appears that they have not been complied with.

To add extra tickets to a new raffle would be definitely illegal.

Maybe they could draw the raffle and whoever wins it gives it back. HA Ha.

This was all done in the lead up to the airshow event which was touted as being an RAAus event, when in actual fact there was a hidden entity running it. That couldn't be so that RAAus could not be held accountable, could it?

Only two weeks left folks, for those ticket-holders to put their name in the hat for the "opportunity" to purchase this aircraft, for the terrific price of only $66,000, inc GST!

That's only 2,200x the cost of an Adult ticket, that's pocket change for you rich pilots. I dunno what youse are all complaing about. Suck it up! Youse pilots are all jet-setting Tom-Cruise lookalikes earning squillions*

*Sarcasm & spelling mistakes are intentional for those that haven't had their morning coffee yet!

I wouldn't buy a ticket just on the uncertainty of actually gaining (and maintaining) legal ownership, even if I did pay the money....

Id have thought if the issue is pushed the best result you could hope for is to added to a list of unsecured creditors

The aircraft wasn't paid for so it cant be burdened.
