There is a substantial error in Schedule 1 Item 11 of the aircraft noise regulations where it states:

 

'Propeller driven aircraft of a maximum take-off weight not exceeding 8618 kg for which an application for a type certificate for the type of aircraft or a derived version was submitted before 17 November 1988'

 

i.e. Item 11 currently applies only to aeroplanes where the TC/CoA process was commenced before November 1988 and the effect is that the Australian regulations don't have a noise standard for those propeller-driven aeroplanes weighing less than 8618 kg where the Type Certificate/CoA process was commenced after 17 November 1988, and this does not agree with Chapter 10 of Annex 16. The latter applies to aeroplanes where the Type Certificate/CoA process was commenced after that date.

 

So Item 11 should state 'Propeller driven aircraft of a maximum take-off weight not exceeding 8618 kg for which an application for a type certificate for the type of aircraft or a derived version was submitted after 17 November 1988'

 

In a phone call to me the Department of Transport and Regional Services said a quick investigation has revealed that 'the typo' was probably in the original 1984 regulations. I don't know what they can do about it in the short term; the Department can hardly go cap-in-hand to the Minister and say "Please Sir, we want to make a small correction to the regulations!" So I guess it will stay as is until there is a planned update.

 

The corrected Item 11 could then affect any non-LSA aeroplane type certificated after November 1988 but the noise certification world-wide is done (during type certification) in accordance with the Annex 16 Chapter 10 documents, rather than any regulatory material, and an aircraft noise compliance statement should appear in the aircraft flight manual; in which case a noise certificate is deemed to be issued and no 'permission' is needed from Airservices. LSA aircraft are not type certificated and a noise compliance statement may not appear in the statement of compliance so a 'permission' should be requested from Airservices.
