My point is about the choice of who to apply the law against. We are all probably guilty of something, I certainly took the odd ballpoint home from work. But nobody ever ordered an attack on me so I was never scrutinized in detail.

 

As for the court case, it is my belief that you can pick the decision in a close case by knowing about who appointed the judge. And they are mainly close cases because 2 parties don't go to court unless they each think they can win.

Firstly I do not know the full details or evidence. I would suggest that although we have probably all transgressed the rules at times we tend to be shy about publicising any transgressions. In this case, the pilot, as far as I can tell would do the same thing in the future (again I do not have the facts) The point is perhaps CASA does not want our planes or pilots to be operated in this way and believe that this case could set a precedent. Many on this forum complain about RA flying morphing into GA, could this be a symptom?

To believe that this person is guilty because of who they are is as stupid as believing that they are not guilty because of who they are

My daughter who is currently studying at University both Criminology and Criminal Justice and has come to the conclusion that it is completely irrelevant whether a person is innocent or guilty, it is which legal team is better. Many of the case studies she has done she says once a person is charged it will cost them in either money or jail time, so they get to pick their poison even if they are innocent.

TRUE STORY OF HOW TO USE CASA AGAINST ITSELF

 

I have had a few run ins with CASA, never went to court or close to it or suspended etc (to be clear - we are still friends ) - just had the personal invite to come and sit down a have a chat with the guys as we have had a complaint from a pilot you declined an instructor rating (he needed more practice on many things) when I was doing checks on pilots. long story short . I failed this guy who should have been more competent, he then complained in writing I did things against the regs. Yes I did bend them a bit, fair call.

 

Having our chat with them and coffee and biscuits with the nice view of the city - I said you gave me the position and then you want me to approve these guys that are taking new students up and cant fly an aircraft to save themselves, let along a innocent student who knows nothing and they could both put a hole in the ground.

 

Gave some other reasons what I did to TEST his competence and he failed many of them.

 

I told the Non Flying CASA guys how it is in the real world and did they want to see channel nine and the court why I failed the guys and WHY CASA was over riding my practical testing. Please take me to court so I can tell his honour and the TV reporters how screwed up the system is and how CASA is causing accidents - deaths because if someone complains that get oh we can over ride that and give you a pass.

 

OUTCOME - The letter was torn up in front of me, they said keep up the good work, and was taken for a lovely lunch at the pub until one of the guys (2ic) had to go and ground a international 747 as a big hole (over two feet0 had been found in the back end, where acid had leaked in rear cargo area.

My good Macquarie street barrister friend of 25 years says the court system is corrupt, if you are a working stiff you are screwed!!! - The answer is - if you cant push 100's of thousands of dollars into the law firm and the other side can OUT spend you - you loose. 97.7% of the time or worse.

 

Any person off the street on a middle income cannot beat the court system if the other side has a no limit cash spend.to the legal system - ASIC - CASA - TAX DEPT - or any gov dept - can always bankrupt an average person by just grinding them into the ground. Talk about a fair a just system.

Any person off the street on a middle income cannot beat the court system if the other side has a no limit cash spend.to the legal system - ASIC - CASA - TAX DEPT - or any gov dept - can always bankrupt an average person by just grinding them into the ground. Talk about a fair a just system.

Yes - and I said 97.7% and your in the tribunal - very green ish - try the bigger courts with say normal people against the banks etc. see how you fair. No picking a fight.

There was a case where this guy was angry with the Commonwealth bank, so he went to his local branch and settled up and closed his account.

 

3 months later he got a bill for about $100 from the bank and he told them to get st#ffed. He won the first court case. He lost the appeal AND his house because in losing, he had ot pay the bank's costs which were by this time way over $100,000. The story was on TV and it made me ashamed of my country. The guy himself could not have afforded an appeal so there was never a level playing field.

23 years ago, I had a bank demand repayment of all outstanding monies from my business (over a million dollars) within 48 hrs - even though all payments were up to date, and there was no outstanding debt of any kind.

 

The entire amount was fully secured by property valued well in excess of the total amount owed (all this property was later sold at or above my valuations).

 

The reason given for the demand? Some "computer projections had been done, that showed there was a possibility, that in 6 to 12 mths time, I might not be able to service the debt owing, and the bank may incur some loss".

 

The result was, all my other assets, apart from the land, were sold at fire sale prices, and I walked away from a $10M business, after 30 yrs of hard work, with nothing to my name.

 

When I saw a lawyer about launching a lawsuit against the bank, (because there are laws covering unconscionable conduct by banks), the lawyer was blunt.

 

He said, straight out - "Let me tell you this much. It will cost you $300,000 to launch the action (this was 1995 dollars, too) - and I can advise you that the bank will adopt every delaying and costly tactic and strategy throughout the entire case - until you run out of money - which will be long before they do".

 

One only has to look at the Bell Group vs the Banks saga, to see how the law operates.

 

Over 28 years of litigation, possibly multiple tens of millions to lawyers - and even then, after 28 years, the banks only called a truce by offering a fraction of the total amount sought.

 

The W.A. Govt brought in legislation to stop the continuing and never-ending Bell Group legal fiasco, and it was rejected as being unconstitutional.

I may have made a mistake in my post about Ashby flying at Kalgoorlie.

 

My co pilot at the time thinks that one of the people who I classified as a passenger, may have been the pilot.

I know of a similar incident onetrack - but this was cause of a bank purchased by a bigger bank. Person came out with 2/3 rds of what they owned but saw 1/3 rd sold at fire sale prices (so I'm told)

And the source. I think the ABC are the only reporters of this so-called investigation. It is in the Labor Party's interest to get at Hanson due to the precarious nature of the Senate. The Coalition would not sensibly do anything to diminish her support.

I would suspect that it is entirely in the interests of the coalition to get Hanson and Ashby. Where are the PHON(y) going to go? They will probably drift back to the right wing of the LNP and continue to promote and support flat earth policies.

Its probably only Karma. After all Ashby sunk the "Slipper", with far less evidence than what is being played out publicly.

And the system and its practicioners border on corrupt. Just ask any of the many MVA folk done over by the Courts.
