Yes, I got that; is the liability limit for something the passenger does which is negligent or is that the maximum to passenger can claim on this policy.

Ok guys. I have quotes from:

Agile

 

Who has had happy experiences with any of these? And especially if you actually had to make a claim and the experience wasn't totally awful.

i like the asra model. they have set up an optional pl policy where the member decides if they want it. 

the reason for this is a lot of gyro pilots fly off farms and out the bush, they have nothing to gain from a large pl cover.

this way the people that fly out of airfields can have cover without putting a burden on  the members that don't want it.

the raa policy has a couple of holes in it.  number 1 i believe is any passenger that tried to get compensation will be told they flew at their own risk as stated on the placards in the aircraft. that may be why there is only 250k cover.

 

number 2, myself and others rely on the raa pl policy alone. what happens if my aircraft catchs fire and damages other aircraft when i am not in it. or if the wind flips it onto another aircraft or vehicle.  the policy covers the member not the aircraft so in theory the aircraft is uninsured while no one is in it.   i may have this arse about but its how i read it.

As I understand it, the passenger is only entitled to a claim of compensation in a crash if the pilot failed in his duty of care, or was outright negligent. The placarded warning simply advises that the RA aircraft is not built to the same standards of safety or scrutiny as a certified aircraft. The passenger is deemed to accept the risk of aircraft failure accordingly.

 

If a wing parted company with the rest of the aircraft in normal flight, with the pilot doing everything correctly, then I'd surmise the passenger would have very little legal standing to mount a claim for compensation.

Number 2 would be correctly interpreted by reading the fine print in the policy. It would have to state whether the members aircraft was insured (or not) when he/she wasn't in it.

raaus will tell you the insurance covers the member for pl, nothing do with the aircraft. the policy goes with me to  any raa aircraft i fly.

In that case, the answer is simple, your aircraft is not insured if you're not in the act of flying it. If you want to cover the chances of your aircraft catching fire while you're nowhere near it, you need hull insurance. If you want to insure it against being picked up by a storm gust, you would need storm damage insurance.

 

All policies must have a clear insurance PDS that comes with them - this document includes information regarding your policies key features, what is covered, what is excluded, claims information, and the companies complaints handling procedures.

go to your raa members portal. i am pretty sure its all in there.

Members Liability Insurance

A cornerstone of protection for members is our unique Members Liability Insurance Policy which provides liability protection for those members of Recreational Aviation Australia Limited who hold a Student Pilot or Pilot Certificate.
