Love to fly Posted Sunday at 02:29 AM Posted Sunday at 02:29 AM "People are not understanding what they are hearing." Yep. Definitely applies to some. 🤷♂️ And some seem to have read news reports and be basing their comments on these. The Coroner's Findings are readily available, reattached here, but... He didn't make an instruction to the DPP because this isn't something a Coroner does. 🤦♂️ But there ARE battle plans being made by organisations who know more than us. Given existing imposed legal costs, money has to be found, that people don’t have. Because the actions of some will invalidate any insurance policies, being paid out. Regardless of DPP actions, some people will suffer major loss, then comes civil action possibilities, too. Either way, it’s a sad day for RAAus……. 1

turboplanner Posted Sunday at 08:57 AM Posted Sunday at 08:57 AM I think we've all been through this before.
onetrack Posted Sunday at 09:06 AM Posted Sunday at 09:06 AM Quote Because the actions of some will invalidate any insurance policies, being paid out. Not necessarily a true and correct statement. Public Liability insurance covers negligence of the policy holder. Insurance payouts may be refused, only if criminal acts are found to have occurred, or false declarations were made by the policy holder when the policy was issued. 2
jackc Posted Sunday at 09:39 AM Author Posted Sunday at 09:39 AM Alleged withholding of evidence or telling lies to a Coronial Inquest is viewed very seriously, and an insurance company could invalidate a policy covering the organisation involved, and the people in it. 1
onetrack Posted Sunday at 09:47 AM Posted Sunday at 09:47 AM (edited) You're confusing insurance policies with a coronial inquiry. Telling lies to a coroner does not affect insurance payouts. The original mistake was issuing an RPC against CASA requirements. That was not a criminal act in itself, it was misinterpretation or error, which is covered under the policy holders insurance. The problems started when a cover-up was initiated to hide the error or misinterpretation of the regulations. Edited Sunday at 09:47 AM by onetrack

It's not hard to envision the problems. Your liability as a member seems to be limited to ONE Dollar. OFFICE bearers have a greater exposure to risk and they have to be covered also. It's also a non profit Organisation, which is interesting. Nev It will be interesting to see what happens to the various office bearers over time. I’m not sure whether you’ve read the Coroner’s report? It seems some actions by office bearers were not in accordance with documented procedures. The issues of concern to the Coroner relate to action / (inaction?) once the question of validity of the pilot’s RPC came to light within the organisation.
jackc Posted Sunday at 10:20 AM Author Posted Sunday at 10:20 AM Regardless of who says what, the buck will stop at the end of it all, with whatever happens. Until then we can all cast our opinions, for what they are worth, in the meantime, right or wrong…….

Wonder what effect that has, on the RAA insurance policy?
facthunter Posted Monday at 12:30 AM Posted Monday at 12:30 AM It's informative to look up what the Purpose of a Coronial Inquest is. It's quite specific. Also what qualifications a Coroner must have. Nev 2 1 1
