Having experience in this area i can talk them through their definition of commerce and make some sense of it. I've heard lots of different interpretations ranging from you cannot charge at all to you can only cover costs and other variations. In Skydogs last post he mentions Commercial Hire. A reasonable assumption however in error as at law its impossible to tranact with yourself. You cannot employ yourself nor can you hire, buy or sell something to yourself. {no slight intended on you Skydog just using your comments as an example of how people can easily get confused with this stuff] Cheers Kent
Guest brentc Posted April 11, 2009 Posted April 11, 2009 It's not commercial if you are charging an hourly rate for your labour (including travel time). If I work for a wage and choose to fly myself (and claim my aircraft on tax), it's not commerial either. As an example, if I'm an IT consultant and I charge $200 an hour and $100 an hour for my travel time, I can then legally fly myself to and from the place where the work will be performed. If the customer is only paying for the time then how I choose to get there is irrelevant. No need to call CASA if you're talking about an RA-Aus aircraft. The same rules apply to both in this instance.
