  1. One quick point: In Qld Section 28 (1) of the Coroners Act 2003 (Qld) authorises the holding of an inquest into a reportable death if the Coroner considers it desirable to do so. If possible the Coroner is required to find: - Whether a death in fact happened; Identity of the deceased; When, where and how the death occurred; What caused the person to die. "The focus is on discovering what happened, not on ascribing guilt, attributing blame or apportioning liability. The purpose is to inform the family and the public of how the death occurred with a view of reducing the likelihood of similar deaths. As a result the Act authorises a Coroner to make preventative recommendations concerning public health and safety, the administration of justice or ways to prevent deaths in similar circumstances in the future."

The pull up on the first run through was really ineffective, which indicates pretty high density altitude to me... he certainly miscalculated the round out, all factors considered (or not). Over pitched maybe? But doesn't really look like it and it appears he was travelling a bit too fast for Vortex Ring State. That is some great footage! Official cause likely to be: He just f&*$#d up!
  3. Yes I agree, they decline regularly to become involved, but sometimes they do assist (latest Flight Safety has one very small example). I don't think it is necessarily the case that they say "no to such a request is that to participate in a police investigation would compromise the aim of the Act under which they operate which stipulates that ATSB investigations are not undertaken to apportion blame or liability to any person." Rather because they can see no significant safety outcome from an investigation of the incident that would warrant expenditure of the finances. What specific conditions and protection does ATSB evidence have in a Coroner's Court? We have to also remember here that Police investigating a death for the Coroner are not always doing so to prosecute someone either, rather to find the place, cause, identity etc.

  7. Make sure whatever you paste in ends in .jpeg and that your photobucket gallery is open to the public generally. EDIT: I see the link does end in .jpg... and obviously not the latter.... also make sure you are looking at the image as you would in its full view from the gallery (not just a thumbnail or in your own profile etc)
  8. They are concurrent powers under the Cth Legislation and the State Legislation. There is nothing stopping the ATSB sharing any information whenever they choose to if they are also conducting an investigation, they do not have to wait, nor does the State Coroner have to make a finding until after any ATSB finding is released. There is also nothing to stop the state Police (or Coroner) requesting ATSB investigate all of the event, or just a particular event/item/equipment etc and report on that to the relevant state authority.

This is only a minority of powers and s 52 sets out the express powers granted to the Commonwealth. There are also provisions in s 51 of the Constitution that are exclusive to the Commonwealth. Concurrent powers exist and are powers that can be exercised by both Commonwealth and the States. Most of the powers granted to the Commonwealth are concurrent. Section 109 provides that the Commonwealth law will prevail where there is a conflict between Commonwealth and State laws. State residuary powers are powers that don’t fall within Commonwealth grants of power. These residuary powers do not lie exclusively in the hands of the States because the boundary between Commonwealth power and State residuary power is fluid and dynamic, not rigid. This is because interpretation by the High Court can expand the powers of the Commonwealth. Like Workchoices and the expansion of the Corporations power under s 51(xx) Edit: Ergo; both the Cth and the States get their power from the Constitution not one or another, nor each other.

    Oil for 503 drifter?

    Saw the add and had a look around... the intramanet doesn't provide a very good list of suppliers. Best I can ascertain price is around $12/l which makes more expensive than Activ 2T and it appears unlikely you could just grab some from any old garage in every other town if you needed some while out XC, though they say it is not problem mixing with any other oil.

    You can add it as an attachment by using the "Upload a file" button which appears besides the "Post Reply Button" or preferably... add the picture to a gallery here (or elsewhere). Get the image location by opening/viewing your picture in the gallery, then right click, 'copy image location' and then make your your reply post normally and use the add/edit image button (above the post you are making you will see the little picture of the tree) - click the tree and in there you right click and 'paste' the image location of your picture. 'Post reply'.
